These Guest Stay Terms & Conditions (Short-Term Occupancy Agreement) (“Agreement”) govern all reservations and stays at Sacred Sands and Lobo Luna. By confirming a reservation and providing a credit card deposit, you acknowledge that you have read, understood, and agree to be legally bound by the terms set forth below.
Definitions
Owner, we, our, or us refers to Niemann Hamm Family LLC, doing business as Sacred Sands.
Guest, you, or your refers to the individual(s) approved on the reservation and any permitted visitors.
Accommodation refers to the short-term lodging reserved by the Guest, as identified on the Booking Confirmation, including:
• The Onyx Room (king bed, primary suite with private patio)
• The Jade Room (king bed, primary suite with junior patio)
• Lobo Luna, a fully private standalone residence associated with Sacred Sands
Booking Confirmation includes the reservation details, rates, dates, occupancy limits, and policies provided at the time of booking.
All information listed on the Rates & Availability page and the Booking Confirmation is incorporated into this Agreement.
1. Occupancy and Term
Check-in begins at 4:00 PM on the scheduled arrival date. Check-out is no later than 11:00 AM on the scheduled departure date. Occupancy automatically terminates at that time.
Any extension of stay must be approved by Owner in writing and is subject to availability and revised charges.
This Agreement constitutes a short-term lodging license only and does not create a tenancy, lease, or right of residency. Any Guest remaining after checkout without written consent will be considered an unauthorized holdover and subject to remedies available under California law.
2. Occupancy Limits and Visitors
Guest Suites (Onyx Room & Jade Room)
• Maximum occupancy: two (2) registered Guests per Suite
• Each registered Guest may host one (1) visiting guest
• Visiting guests must vacate the property by 10:00 PM
Lobo Luna
• Occupancy limits are as stated on the Booking Confirmation and Rates & Availability page
• Only registered Guests may occupy the residence overnight
• Day visitors must comply with quiet hours and parking rules
Pets and Animals (Applies to All Accommodations)
Pets are not permitted on the property under any circumstances.
Emotional support animals, comfort animals, and therapy animals are not service animals and are not permitted.
Only animals that qualify as service animals under applicable law are exempt.
Unauthorized guests, animals, or exceeding occupancy limits may result in additional charges or immediate termination of stay without refund.
Events
Sacred Sands and Lobo Luna may be used for events only with prior written approval. Event inquiries must be directed to Events@SacredSands.com.
3. IMPORTANT: RESERVATIONS, BILLING, AND CANCELLATION POLICY
Third-Party Bookings
Reservations made through third-party platforms (including Airbnb, Booking.com, Expedia, or similar services) are governed exclusively by the cancellation and modification policies agreed to on those platforms. Those policies supersede this Agreement.
Direct Bookings (SacredSands.com or Phone)
• A 50% deposit is required for reservations made more than fifteen (15) days prior to arrival and will be processed 24 hours after booking confirmation.
• Reservations made within fourteen (14) days of arrival will be charged the full reservation amount 24 hours after booking.
California 24-Hour Cancellation Right
In accordance with California law, Guests may cancel a direct booking within twenty-four (24) hours of booking without penalty, provided the reservation was made at least seventy-two (72) hours prior to the scheduled check-in date. After this period, the standard cancellation policy applies.
Standard Cancellation Terms (Direct Bookings)
• Reservations that enter the fourteen (14) day arrival window are not eligible for a refund, including cancellations, no-shows, or early departures, regardless of reason.
• For reservations made more than fifteen (15) days prior to arrival, cancellations submitted fifteen (15) or more days before check-in are eligible for a refund less a 4.5% credit card processing fee. In lieu of a refund, Guest may elect to apply the full amount paid toward a future stay to avoid processing fees. Future stay credits are subject to blackout dates and rate changes.
• The remaining balance of all reservations is charged fourteen (14) days prior to arrival.
• No refunds or credits are issued for no-shows, early departures, or cancellations related to COVID-19 or similar circumstances. Guests are strongly encouraged to purchase travel insurance.
• All rates are subject to applicable state and local taxes.
Guest acknowledges that cancellation terms are clearly disclosed at booking and that failure to appear, early departure, or cancellation outside the permitted window does not entitle Guest to a refund.
4. Security Deposit and Damages
A $250 security deposit authorization will be placed on the Guest’s credit card at check-in (or prior to arrival for Lobo Luna stays). Following departure, the Accommodation will be inspected.
Guests are responsible for all loss or damage caused by themselves or their visitors. If damages exceed $250, Guest authorizes Owner to charge the remaining balance to the card on file.
5. Fire Safety
Due to extreme wildfire risk, outdoor fires are strictly prohibited unless expressly approved in writing by Owner. Unauthorized fire activity may result in immediate termination of stay without refund and liability for damages.
6. Smoking Policy
Sacred Sands and Lobo Luna are tobacco-free properties. Smoking is prohibited in all interior spaces and designated outdoor areas. Violations may result in cleaning charges up to $1,000 and immediate termination of stay without refund.
7. Appliances and Equipment
Appliances and amenities are provided as-is. Owner will make reasonable efforts to repair failures; however, no refunds will be issued for equipment malfunction.
8. Internet Service
Complimentary WiFi is provided without guarantee of speed or reliability due to the rural location.
9. Force Majeure
If events beyond reasonable control prevent delivery of the Accommodation, Guest’s sole remedy shall be a credit toward a future stay within one (1) year.
10. Access and Entry
Guests will be provided a unique keypad access code valid only for the reservation period. Sharing access codes or tampering with security systems may result in immediate termination without refund.
11. Desert Environment, Plants, and Wildlife
Guests acknowledge natural hazards inherent to a desert environment and assume all associated risks.
12. Guest Responsibility and Liability
Guests assume responsibility for their use of the Accommodation. Owner is not responsible for loss, theft, or injury except where required by California law.
13. Prohibited Use and Termination
The Accommodation may not be sublet or transferred.
Designation of a replacement guest pursuant to Section 3 does not constitute a transfer or subletting.
Illegal or disruptive activity may result in immediate termination without refund.
14. Governing Law
This Agreement shall be governed by the laws of the State of California.
15. Local Ordinances (San Bernardino County)
• Quiet hours: 10:00 PM – 8:00 AM
• No amplified sound audible beyond property boundaries
• Parking permitted only in designated areas
16. Indemnification
Guest agrees to indemnify and hold harmless Owner to the fullest extent permitted by California law.
Acknowledgment
By confirming a reservation, Guest acknowledges they have read, understood, and agreed to these Guest Stay Terms & Conditions (Short-Term Occupancy Agreement).
I acknowledge that this stay constitutes a short-term lodging license and does not create tenancy, lease, or residency rights under California law.
